These terms and conditions of sale govern the website design and maintenance services provided by Thibault Vergères, trading as TibWebs. Any order implies unreserved acceptance of these terms.
TibWebs designs showcase and custom websites and offers related services (SEO, visual identity, copywriting, hosting, maintenance). The exact scope of each service is defined in the quote approved by the client.
Every project is subject to a personalised, free quote setting out the scope, fixed price and timeline. The quote is valid for 30 days. The order becomes firm once the quote is approved in writing (email or signature) and the deposit is paid.
Prices are shown in Swiss francs (CHF). TibWebs is not subject to VAT; no VAT is charged. The fixed price agreed in the quote does not change, unless the client requests a change of scope, which is then subject to an additional quote.
Unless otherwise stated in the quote, a 30% deposit is due on order, with the balance due when the site goes live. Payment is made by bank transfer or card through our secure provider Stripe. In the event of late payment, go-live or maintenance may be suspended until settlement.
The maintenance subscription (“Sérénité”) is billed monthly and renews automatically each month. It has no fixed term: you can cancel it at any time from your client area, cancellation taking effect at the end of the current monthly period. Monthly payments already made are non-refundable.
The stated timelines (around three weeks for a showcase site) start once all required content and information have been received. The client undertakes to provide content they hold the rights to and to actively take part in the approval stages. Any delay attributable to the client shifts the timeline accordingly.
A revision phase is included in every project, within the scope defined in the quote. Requests beyond that scope or the initial brief are subject to an additional quote.
After full payment, the client owns the delivered site, its domain name and its content. Some third-party components (libraries, fonts, software building blocks) remain subject to their respective licences. TibWebs reserves the right to mention the project in its portfolio, unless the client requests otherwise.
TibWebs provides its services with care and professionalism (best-efforts obligation). It cannot be held liable for indirect damage, loss of data or business, or interruptions attributable to third parties (host, networks). In any case, liability is limited to the amount of the service concerned.
The processing of personal data is described in our privacy policy, which forms an integral part of these terms.
These terms are governed by Swiss law. In the event of a dispute, an amicable solution will be sought first. Failing that, jurisdiction lies at the publisher's domicile, subject to any mandatory legal provision to the contrary.
